NEDDC Local Plan Issues and Options Consultation on the Strategic Approach to the Location of Development and Refined Sites (March 2026)

Proposed Approach to the Location of Development

Representation ID: 14712

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The respondent states that Local Plans are assessed against legal and procedural requirements and tests of soundness, including being positively prepared, justified, effective and consistent with national policy. They state a Local Plan must seek to meet objectively assessed needs and be informed by cooperation with neighbouring authorities. They also state it must enable sustainable development in accordance with the National Planning Policy Framework.
The respondent states it is essential that sufficient homes are planned for, with an appropriate range of sites in sustainable locations, and that housing need should be met in full. They state the standard method represents a minimum starting point and support meeting the 12,000 dwelling requirement, but express concern that lower housing targets are being considered without strong evidence. They note the Green Belt Review is not yet available.
They state the spatial strategy directing growth to sustainable settlements is appropriate and support maximising development outside the Green Belt. They state exceptional circumstances for Green Belt release have not yet been demonstrated and alternatives should be fully examined first.
The respondent notes opportunities at Holmewood and Heath and identifies ongoing demand for employment land and logistics provision.

NEDDC Local Plan Issues and Options Consultation on the Strategic Approach to the Location of Development and Refined Sites (March 2026)

Settlement Hierarchy

Representation ID: 14714

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The respondent states that plans should promote a sustainable pattern of development that meets development needs, aligns growth and infrastructure, improves the environment, and mitigates and adapts to climate change. They state that strategic policies should provide a clear framework for development and that the existing settlement hierarchy is a sound and appropriate starting point for directing sustainable growth.
The respondent supports the proposed settlement hierarchy and its methodology, stating it identifies sustainable settlements. They state that planning policies should respond to local circumstances, support housing delivery reflecting local needs, and direct development to locations that maintain or enhance community vitality. They state that development in one settlement can support services in another.
The respondent states that additional housing in lower order settlements could support existing services and facilities, while not allocating growth could reinforce poor sustainability. They highlight the need to understand functional relationships between settlements.
The respondent supports maximising development outside the Green Belt and the cascade approach but states higher order settlements may be constrained. They state that development should be prioritised in sustainable locations outside the Green Belt, and that all reasonable alternatives should be fully examined before any Green Belt release is considered.

Sustainability Appraisal (SA)

Representation ID: 14720

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The respondent states that the Local Plan must be informed by a Sustainability Appraisal that complies with legal and procedural requirements. They recognise that the SA provides a comprehensive assessment of how the emerging Plan considers economic, social and environmental objectives, but note that it is not the final assessment and will inform later decision making.
The respondent highlights that assessments have been undertaken without detailed mitigation, meaning outcomes may change and sites not currently preferred could offer development advantages. They also note that the SA is based on incomplete information, with further data expected to inform later stages, including site-specific evaluations of heritage impacts.
Concerns are raised that the SA does not include mapped information on the setting of heritage assets, including the role of land in protecting the setting of Bolsover Castle, Hardwick Hall and Sutton Scarsdale Hall. It is stated that the basis for some conclusions is unclear and that opportunities to avoid or mitigate impacts are not fully explained.
The respondent states that the SA must ensure underlying data and conclusions are accurate, robust and consistently evidenced, to avoid unsuitable outcomes. They conclude that the SA must be transparent and capable of supporting sound decision-making.

NEDDC Local Plan Issues and Options Consultation on the Strategic Approach to the Location of Development and Refined Sites (March 2026)

45152 – Land to West of Slack Lane, Holmewood

Representation ID: 14721

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The site is fully owned by the Devonshire Group and its allocation for residential development is supported.
Site 45152 offers the opportunity for ‘organic’ growth of Holmewood that is close to key local services (primary school within easy waking distance) and unencumbered by major constraints. The proposed National Grid overhead electricity line referenced within the consultation does not directly impact the site in-so-far as pylons would not be located within the site and transmission lines would not cross it. Dwellings could be positioned so as to avoid direct or otherwise detrimental views of/towards the pylons and lines, if the new line is commissioned. Site masterplanning could address any landscape sensitivities, through avoiding development on more prominent parts of the site and / or through the introduction of structural landscaping/tree planting. Other matters, including surface water drainage and provision of access, can also be addressed though masterplanning.

45192 – Land to north of Mansfield Road, Doe Lea (within Heath & Holmewood Parish)

Representation ID: 14722

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The site is fully owned by the Devonshire Group and its allocation for employment use is supported.
The site’s location within the ‘heritage triangle’ is acknowledged. As identified by the referenced Landscape Assessment, the site is screened in the local landscape due to its low lying levels relative to the M1 motorway and the A617 Mansfield Road together with extensive boundary vegetation. Additional landscape screening could be introduced as part of site masterplanning. The site does not present any technical constraints that could not be overcome, including avoiding areas identified as being at an elevated level of flood risk. The site is very well located to take advantage of transport connectivity provided by the M1.

Heath

Representation ID: 14723

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The respondent welcomes the identification of sites around Heath as potential housing sites and states that they own all or large parts of these sites. They state that limited development has taken place at Heath due to its Conservation Area designation and limited services and facilities, but that the settlement presents opportunities for development that could contribute to housing needs and support the village without harm to important characteristics.
The respondent states there is potential for both smaller-scale development and more significant expansion to the west of the built-up area. They state that such development could support the vitality and viability of existing services and allow for the introduction of additional services and facilities.
The respondent states that, as an experienced developer, they could take a lead role in masterplanning and delivering development, working with the Council and community. They state that more modest schemes could also be delivered through a masterplan approach, including sites at the north-western edge of the village such as Smithy Farm, land to the east, and land south of Mansfield Road.
They state that development in this area would extend the ribbon form of Heath without detriment to its historic core.

45120 – Smithy Farm, Mansfield Road, Heath

Representation ID: 14726

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The site is fully owned by the Devonshire Group and its allocation for residential development is supported.
The site is previously developed land. The Council has previously supported residential development by way of the grant of outline planning permission for 8 dwellings. Comprehensive evidence demonstrating its suitability, capacity and deliverability was submitted under previous planning applications, confirming that there are no technical barriers to the site's redevelopment (see planning applications ref. 18/00287/OL and 23/00286/FL). As identified in the consultation document, the site could be combined with neighbouring site 45122 to the east to deliver a larger residential allocation. Development of the site, on a stand alone basis or with the adjacent site to the east, would be consistent with the established ‘ribbon’ development character established by the village’s growth over time.

45122 – Land to East of Smithy Farm, Heath

Representation ID: 14728

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The site is fully owned by the Devonshire Group and its allocation for residential development is supported.
The site represents an infill opportunity on a modest paddock, the frontage of which is already broken by residential development. The site could be developed independently or in conjunction with Smithy Farm, to the west. The site wraps around one existing dwelling (‘Rose Cottage’), with the A617 to the north and residential uses to the east and south. The former farmstead and commercial yard of Smithy Farm is to the west. Connections to all mains utilities are available or could be provided to an appropriate standard. There is an existing field access on to Mansfield Road A new / improved access point could be created onto Mansfield Road.
Development would link existing residential development to previously developed land (Smithy Farm – see site 45120), thereby maintaining the linear character of the village.
The site falls within Heath Village Conservation Area. An appropriately high quality design / layout could be achieved having regard to the special character and appearance of the local area. Existing boundary trees and hedgerows could be retained. Noise from the A617 to north can be satisfactorily addressed through appropriate design (see technical details submitted in support of planning applications at Smithy Farm site ref. 45120).

45145 – Ivy Farm, Heath

Representation ID: 14734

Received: 30/04/2026

Respondent: The Devonshire Group

Agent: Planning and Design Group

Representation Summary:

The site is fully owned by the Devonshire Group and its allocation for residential development is supported.
Although located on the edge of the village, the immediate locality is characterised by residential development to the north, east and west (field intervening), with agricultural land to the south and immediate west.
The site could be developed independently or development of the site could be considered as part of a wider ‘cluster’ of sites around this western edge of the village. This could include land to the east, south and west.
