NEDDC Local Plan Issues and Options Consultation on the Strategic Approach to the Location of Development and Refined Sites (March 2026)
Respondent: Stainton Planning
Representation Summary:
Site 45005 (adj 64 Pilsley Rd Danesmoor) should be included as a housing site allocation.
The Council has confirmed that the employment allocation is no longer relevant given the new housing development surrounding the site.
There is no evidence for the Council's 'amber' conclusion on heritage impacts. The Inspector for the development to the rear did not consider there to be any heritage concerns.
Coal Mining legacy can be fully considered by a site investigation at the time the site comes forward.
This site 45005 is previously developed land which is available for development and should be allocated.
Full text:
We consider that Site 45005 (land east 64 Pilsley Road, Danesmoor) should be shown on the Clay Cross Plan as a housing site -or as being in the adjacent Pilsley Parish as a housing site.
This site was awarded an overall conclusion of Amber in the LAA although the issues raised can be addressed as part of any development scheme and we believe the correct conclusion is green.
Site 45005 is an infill site, seen as part of the Clay Cross settlement, it is previously developed land which is surrounded by housing, it is no longer suitable for employment development due to the housing constructed to the rear (allowed on appeal). The policy-on capacity has been concluded to be 11 dwellings.
The appeal inspector for 16/01260/OL (land to the north of this site) did not have any concerns about impact on any heritage assets. The Inspector was also satisfied that ground conditions could be satisfactorily addressed.
The site lies within the Coal Mining High Risk Area (although it is outside the area that was previously opencast), as does a significant proportion of North East Derbyshire. Full site investigation will be undertaken at the time of a planning application and there is no reason to believe that the legacy from former coaling works cannot be mitigated.
