North East Derbyshire Publication Draft Local Plan (Reg 19)

Representation ID: 7672

Received: 04/04/2018

Respondent: Mr Stephen Clough

Legally compliant? No

Sound? No

Duty to co-operate? No

Representation Summary:

Council officers have amended the summary to approximately 100 words. Full representation attached.
Plan not legally compliant for a number of reasons:
-Alternative Brown Field sites in NED for the required housing, including in Killamarsh.
-Killamarsh has limited GB land and cannot support building on this type of land.
-Analysis of Killamarsh wasn't appropriate. Failure to account for other developments in the area and impact existing infrastructure. Existing issues with traffic not taken into account.
-Making minor changes to bridges not designed to take the level of traffic now, will only increase the damage to important access points
-Plan doesn't meet Sustainability Appraisal requirements.
-Plan doesn't comply with Planning Regulations due to focus on GB areas in Killamarsh.
-Plan has total disregard to the Sustainable Communities Strategy for the area it covers.
-Plan hasn't been carried out correctly as analysis does not truly reflect that of the Parish residents or reality.

Change suggested by respondent:

There needs to be a thorough review in consultation with residents of the traffic management system in Killamarsh, taking in to account Peak Time travel.
There also needs to be a thorough review of housing currently been built at Clowne, Halfway and Mosborough and the impact this has now on and will have on Killamarsh in the future.
Alternative Brown Field sites need to be considered in all North East Derbyshire before Green Belt land in Killamarsh.
More consideration need to be taken in to account to review the infrastructure, including the whole road network e.g. cut through from M1 by industrial vehicles to Industrial Estate in Sheffield.

I believe that this aspect of the plan is not legally compliant for a number of reasons,
1) There are alternative Brown Field sites in North East Derbyshire that could absorb the required housing, including Brown Field sites in Killamarsh.
2) Killamarsh has limited Green Belt land in inside the Parish and as such cannot support building on this type of land. This would mean the loss of very valuable land that is used as Green Belt land by residents.
3) The analysis of Killamarsh has not been undertaking in an appropriate manner by the report writers and as such they have failed to take in to account other developments surrounding the area and the impact this will have on Killamarsh and its infrastructure. The area currently struggles with traffic, especially at peak times and this has not been taken in to account.
4) Making minor changes to bridges not designed to take the level of traffic now, will only increase the damage to important access points, with the potential loss in the near future and the cost of replacement.
5) The plan is certainly not a sound one and needs to be revised.
6) The plan does not meet Sustainability Appraisal requirements as highlighted above.
7) The plan does not comply with Town & Country Planning Regulations due to the focus on all the green belt areas in Killamarsh.
8) The plan has total disregard to the Sustainable Communities Strategy for the area it covers.
9) The draft plan has not been carried out correctly as analysis does not truly reflect that of the Parish residents or reality.
